Who these terms apply to
These terms govern your use of wimly.com (the "site") and any purchase of access to Wimly. They are issued by Wimly AB, a Swedish company ("Wimly AB", "we", "us"). The Wimly Patient Intelligence platform ("Wimly") is the software application made available by Wimly AB.
By browsing the site you accept these terms. By making a purchase you enter into a contract with Wimly AB on the terms set out below.
What Wimly is — and is not
Wimly is a software application for documenting personal observations. Wimly does not provide medical, clinical, or therapeutic services and is not a medical device. Wimly does not diagnose, treat, prevent, or cure any condition, and does not provide health, clinical, or therapeutic advice. Users are responsible for their own healthcare decisions and should consult licensed healthcare professionals for medical matters.
Using this site
The site is provided for information about Wimly. You may use it for lawful purposes only. You may not:
Attempt to disrupt, damage, or gain unauthorised access to the site or its infrastructure
Reproduce substantial portions of the site's content for commercial purposes without written permission
Use the site to transmit unsolicited or harmful communications
We reserve the right to change, suspend, or withdraw any part of the site without notice.
Purchases
What a purchase is
A purchase of Wimly access is a commercial transaction — a license to use Wimly. It is not a charitable donation and is not tax-deductible in any jurisdiction we are aware of.
By completing a purchase, you enter into a binding contract with Wimly AB on these terms.
What you receive
The features and benefits included with each tier are described on the relevant purchase page at the time of purchase. Benefits are personal and non-transferable unless specified otherwise in your tier description.
Delivery
Access to Wimly will be provided to the email address used at purchase. You will be notified by email when access is granted. We will not sell or transfer your entitlements to a third party without your consent.
If access is not granted
If access to Wimly is not granted within 12 months of your purchase date, you are entitled to a full refund. To request one, write to hello@wimly.com.
EU cooling-off right
If you are a consumer in the European Union, you have the right to cancel your purchase within 14 days of completing the transaction, without giving any reason (the cooling-off period under the EU Consumer Rights Directive). To exercise this right, notify us at hello@wimly.com within 14 days. We will refund you within 14 days of receiving your cancellation, using the same payment method you used.
Once access to Wimly has been granted and you have begun using it, you may lose the right to cancel if you have expressly requested that the service begin during the cooling-off period.
Payment
Prices are stated in US dollars (USD) at the time of purchase. Payments are processed securely through XXXXX, who acts as the Merchant of Record for all transactions. XXXXX is responsible for transaction handling, compliance, and tax remittance, including the collection and remittance of all applicable sales taxes. Wimly AB does not receive or store your payment card details. Currency conversion rates are determined by your bank or card provider.
Intellectual property
The content on this site — including text, design, graphics, the Wimly name and logo — is the property of Wimly AB and is protected by copyright. "Patient Intelligence" is a trademark of Wimly AB. You may not reproduce substantial portions of site content without written permission.
Liability
The site and its content are provided "as is". We make reasonable efforts to keep the site accurate and available but do not guarantee this. To the extent permitted by law, Wimly AB's liability in connection with use of this site is limited to the amount you have paid Wimly AB in the preceding 12 months.
Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or any other matter that cannot be excluded under applicable law.
Platform terms
Separate terms govern use of Wimly. These will be provided before access is granted.
Governing law
These terms are governed by Swedish law. Disputes that cannot be resolved amicably will be submitted to the courts of Sweden, with Stockholm District Court as the court of first instance. If you are a consumer in the EU, mandatory consumer protection rights in your country of residence are unaffected.
